General information, not legal advice

The pages here explain the Telephone Consumer Protection Act, FCC rules, state telemarketing laws, and court decisions in general terms. Laws change, courts disagree, and small facts can change the answer. For example, the Supreme Court held in 2025 that federal district courts are not bound by the FCC’s interpretation of the TCPA, so some rules may be read differently from one court to the next. Do not act, or decide not to act, based only on what you read here.

No attorney-client relationship

Submitting a form or calling does not create an attorney-client relationship. Neither does reading this site, sending an email, or leaving a voicemail. An attorney-client relationship begins only when a lawyer agrees to represent you in a signed written agreement. Until then, no lawyer is watching your deadlines for you. The federal deadline for most TCPA claims is four years from each call, explained on our statute of limitations page.

Referrals and co-counsel

Banville Law may refer your matter to, or work as co-counsel with, another law firm. You will be told before any referral and may choose other counsel. Where the rules of professional conduct require it, fee division between firms and each firm’s responsibility will be explained in writing and requires your agreement.

Fees

Case reviews are free. Where Banville Law or a co-counsel firm takes a case on contingency, there is no attorney fee unless you recover. Contingency fee agreements must be in writing. Ask how court costs and expenses are handled, since they are separate from the fee.

Jurisdiction

Laurence Banville is admitted in New York and the District of Columbia and is not admitted in Pennsylvania or other states. This site is not an offer to represent anyone in a state where it would not comply with that state’s advertising or ethics rules. Cases in other states are handled only with a lawyer admitted in the proper court.
